- Use the Site to engage in any fraudulent activity, including but not limited to using stolen payment credentials or placing fraudulent orders.
- Post or transmit any content that is defamatory, obscene, threatening, harassing, hateful, racially or ethnically offensive, or otherwise objectionable.
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used in connection with the Site.
- Violate or attempt to violate the security features of the Site, including accessing data not intended for you.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including reporting such violations to law enforcement authorities.
4. Online Ordering, Payments, and Pricing
4.1 Order Placement and Confirmation
All orders placed through the Site are subject to acceptance by Anthony's Coal Fired Pizza. Submission of an order constitutes an offer to purchase; a binding contract is not formed until we confirm your order via email or other communication. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to product unavailability, inaccuracies in product or pricing information, or suspected fraud.
4.2 Pricing

We make every effort to ensure pricing accuracy; however, if a pricing error is discovered after an order has been placed, we will notify you and provide the option to confirm the order at the correct price or cancel the order for a full refund.

8. Limitation of Liability

- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
- DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;
- DAMAGES ARISING FROM ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
- DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON OR THROUGH THE SITE;
- ANY OTHER INDIRECT OR CONSEQUENTIAL DAMAGES.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability shall be limited to the greatest extent permitted by law. In all cases, our aggregate liability to you for any claims arising out of or related to your use of the Site or our services shall not exceed the amount you paid to Anthony's Coal Fired Pizza in the ninety (90) days preceding the event giving rise to the claim, or one hundred dollars ($100.00), whichever is greater.
Some states, including those with specific consumer protection statutes, may not allow certain limitations of liability. In such jurisdictions, the above limitations may not apply to you in their entirety.
9. Indemnification
You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, service providers, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

- Your violation of any rights of a third party, including intellectual property rights, privacy rights, or consumer protection rights;
- Your violation of any applicable federal, state, local, or international laws, rules, or regulations;

You represent and warrant that you own or have the right to submit such User Content, and that the User Content does not violate the rights of any third party. To the extent that any legal action is not subject to mandatory arbitration as described in Section 13, you hereby consent to the exclusive personal jurisdiction and venue of the federal and state courts located in the United States for the resolution of any disputes. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
The Site is operated from the United States. We make no representations that the content or services are appropriate for use in other locations. Those who choose to access the Site from other locations do so at their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
These Terms are governed by the Federal Arbitration Act, applicable federal law, and the laws of the United States. In matters of consumer protection, the Federal Trade Commission Act (FTC Act) and other applicable federal consumer protection statutes shall apply.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal dispute proceeding, you agree to first attempt to resolve the dispute informally by contacting Anthony's Coal Fired Pizza at [email protected]. We will attempt to resolve the dispute informally within thirty (30) days of receiving notice of the dispute. If the dispute is not resolved within this period, either party may proceed to binding arbitration as described below.
13.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except for disputes that qualify for small claims court, and except as otherwise provided herein, you and Anthony's Coal Fired Pizza agree to resolve any disputes, claims, or controversies arising out of or relating to these Terms or your use of the Site or services through binding arbitration rather than in court. This includes disputes arising out of or relating to interpretation or application of this arbitration provision, including its enforceability, revocability, or validity.
Arbitration shall be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA), including the AAA's Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in the English language.
13.3 Class Action Waiver
YOU AND ANTHONY'S COAL FIRED PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both you and Anthony's Coal Fired Pizza waive any right to a jury trial and waive any right to participate in a class action lawsuit or class-wide arbitration.
13.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
14. Term and Termination
These Terms of Service are effective as of the date you first access or use the Site and shall remain in full force and effect for as long as you use the Site or our services, unless earlier terminated in accordance with these Terms.
We reserve the right, in our sole discretion and without notice or liability, to:
- Terminate or suspend your access to the Site or any portion thereof;
- Terminate or suspend your account for any reason, including violation of these Terms;
- Delete any account or content associated with your account;
- Refuse service to any person for any lawful reason.
You may terminate your account at any time by contacting us at the email address provided below. Upon termination, your right to access and use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

The parties agree that the court or arbitrator should endeavor to give effect to the parties' intentions as reflected in the invalid or unenforceable provision, and the other provisions of these Terms shall remain valid and enforceable. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site and our services.
No waiver by either party of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default. The section headings used in these Terms are for convenience only and shall not be given any legal import.
18. Force Majeure
Anthony's Coal Fired Pizza shall not be liable for any delay or failure to perform any obligation under these Terms where such delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or restrictions, labor disputes, supply chain disruptions, power failures, internet outages, terrorism, civil unrest, or any other event beyond our reasonable control. In the event of a force majeure, we will make reasonable efforts to notify you and resume performance as soon as reasonably practicable.
19. Accessibility
